15 Nov NO, Texas Has NOT Banned Sharia … Yet
Several Texas leaders announced recently that Texas has “banned sharia.”
Many Texans celebrated those announcements, because they know that sharia, Islamic law, irreconcilably conflicts with the Texas and US constitutions, and with America’s fundamental commitment to the freedom of the individual.
Unfortunately, Texas has NOT banned sharia yet, but voters will have the opportunity to support that goal on the March 2026 primary ballot, as explained below.
To understand why this urgently matters, it is important to grasp (1) what sharia is,
(2) that attempting to impose sharia on non-Muslim countries is a tactic of war, a surreptitious, manipulative, insidious often piecemeal tactic of Islamic conquest and (3) that the Islamization of Texas is already underway, and the sooner we stand boldly and openly reject sharia, and stand strong for our state and federal constitutions and laws, and for our Judeo-Christian roots and our culture of freedom, the better and safer we are.
What Sharia is
Baked into sharia is absolute control over every aspect of human existence. It is so all encompassing that it IS the entire law in some Muslim countries, and a controlling part of the law in many others. Sharia cannot meld with or blend into the U.S. constitution, state constitutions, or duly passed laws by elected officials, because sharia is intended as a replacement for our laws and system.
Sharia is a system of laws that no one on earth is ever allowed to change. Under sharia there is no freedom of speech, no freedom of religion, no representative government, and no equal rights of women. To name but a few.
Sharia penalties are extreme and barbaric. The death penalty is required for apostasy (trying to leave the religion) and for blasphemy (saying, drawing, writing, sharing anything that is offensive about Islam, the Quran, Muhammed). It calls for (and utilizes still today!) barbaric punishments such as stoning people to death, and cutting off hands and feet. Sharia is irrefutably and incurably incompatible with Texas, freedom, and America.
Inflicting Sharia on Non-Muslims is a Tactic of Islamic Conquest
- Islam is and always has been a conquest ideology, with a 1,400-year history of murderously, violently conquering Christian and other non-Muslim nations, forcing “infidels” (non-Muslims) to convert to Islam, be killed, or be subjugated, all driven and justified by sharia.
- Sharia is central to the Islamist conquest ideology. The Muslim Brotherhood vowed from its founding in 1928 to fight to establish an international caliphate (whole world ruled by Islam) under sharia. Pursuing the mission of imposing sharia on the world is the duty of millions of devout Islamic supremacists.
- The Muslim Brotherhood vowed decades ago to conquer America utilizing “civilization jihad” – and one key method is to slowly manipulate the American culture into submission to Islam by pushing adherence to sharia. Jihad is holy war to bring the world into submission to Islam, and can be violent, and can be surreptitiously peaceful, but the goal is always the same: forcing submission to Islam and sharia.
- As is evident from the Organization of Islamic Cooperation (OIC) pushing for the UN to adopt sharia compliant rules banning blasphemy, (and abandoning that effort in 2012) and from ongoing efforts by the Muslim Brotherhood to force the EU to criminalize blasphemy, the mindset of the devout Islamist is always the same everywhere: the non-Muslim world should be forced to submit to sharia. The OIC continues on a brazen Islamization mission, as described well here by Amy Mek: as an “intergovernmental bloc whose purpose is to erode classical Western principles such as freedom of speech and freedom of conscience, to negate equality before the law, and to construct a matrix of Islamic dominance over international norms.”
The Islamization of Texas is Already Underway
- Numerous dangerous, radical imams have moved to Texas in recent years, including Yasir Qadhi who tried the EPIC community scheme to set up an Islamic No-Go Zone in Plano (which is still underway and now called The Meadow), and who is chair of the FIQH Council which interprets sharia in America, and a member of a Hamas-tied Muslim Brotherhood network.
- There are numerous other dangerous Islamic imams and organizations embedding themselves in Texas. Texas is in the midst of an avalanche of Islamic immigration, evidenced by new mosques and proposed new communities and schools all over the state, where sharia is taught and advocated.
- Sharia courts or tribunals are in place in Texas inside Islamic centers, now. One case that dealt with a sharia court prenuptial agreement is discussed HERE.
- Imams and other Islamic leaders regularly say they plan to take over America, and the incursion in Texas today is especially aggressive and alarming. HERE one imam is agreeing “of course we will take over America,” and HERE an American Muslim calmly explains that America is a Muslim country and his religion will take over every household in America, and HERE a Houston imam is attempting to impose sharia on Houston business owners.
We need a massive public rejection of sharia in America, a message that we choose freedom and absolutely will never submit to Islam or sharia. Sharia must ALSO be rejected as a defense for otherwise unlawful conduct. Sharia permits honor killing of one’s own children, female genital mutilation of young girls, and countless other acts that are unlawful in Texas.
Unfortunately, no bill passed in Texas even comes close to “banning sharia,” though three make some tiny headway:
- Most recently, the 89th Texas Legislature passed House Bill 4211, that outlawed one tactic/scheme concocted by Islamic EPIC developers to discriminate, to try to create a Muslim-only No-Go Zone community and to ban non-Muslims, from that development. But this bill did not even address, much less ban, sharia.
- Another law that some Texans incorrectly believe “outlawed sharia in Texas,” is HB 45 which took effect in September 2017. It would have barred all foreign law including sharia, but was watered down into meaninglessness so that now it applies ONLY in family law cases, and even in those cases, only in very limited circumstances. This bill potentially weakened one narrow aspect of sharia; it did not come close to banning all of it.
- Female genital mutilation (FGM)—which involves cutting off the clitoris of very young girls—is a common practice in some Islamic communities and is authorized by sharia. Chapter 167 of the Texas Health Code , enacted in 1999, prohibits this practice in Texas. But it did not ban all of sharia.
Tinkering at the edges of property rights in HB 4211, and family law in HB 45, and the Texas Health Code, while helpful, does not address the vast scope of sharia and its irreconcilable conflict with the American rule of law.
Texas (and all states, and the federal government!) must ban sharia, for the same reason that we banned slavery, and reject communism and totalitarianism. None of these can blend in with our state and federal constitutions or with our laws.
In March 2026, voters in the GOP primary ballot will be asked to vote yes or no on an advisory proposal to prohibit sharia in Texas. An overwhelming ‘yes’ vote is the demand of these times. The Texas legislature can follow up to codify the ban, and send a clear message that Texas will not honor sharia.
Before that vote, a top priority is to spread understanding on this issue. This initiative to ban sharia is all about love for America and freedom. It is about preserving America’s fundamental and profoundly important constitutional structure and commitment to personal individual freedom, and our Judeo-Christian heritage, against an all-encompassing ideology that would overthrow our republic, and destroy that heritage and the culture of human flourishing and freedom it has produced.
